Critical Race Theory

A very well written piece, albeit there are some words the left may need a dictionary to understand what he saying. LOL. A mostly retired trial lawyer who began as a Marine JAG Officer 1975-1982.

He poses a great question we all should be asking today, and does a great job answering it. Worth the read! Thank you Michael for sending it to me.

“What is wrong with critical race theory?”

Once the exclusive domain of deep thinking university professors, critical race theory became a part of our national conversation when the Trump administration ordered federal agencies to stop conducting workplace training based on critical race theory and opened an inquiry into the City of Seattle’s use of it.  The training is in fact political indoctrination and the public ought to know what it is and why it should be resisted.

Critical theory sprung largely from the Marxist scholars of the Frankfurt School in 1930’s Germany.  In 1848 Karl Marx had introduced the world to an analysis of social relations characterized by oppression when he argued in The Communist Manifesto and Capital that working class laborers were oppressed by those in power, the owners of capital. He argued for class consciousness, and in advocating radical change, he famously argued the workers had nothing to lose but their chains.  The dilemma facing the Frankfurt School scholars was why after the Russian Revolution and the wide dissemination of Marx’s invitation to a workers’ paradise was it not being realized?  Industrial organization and mass communications seemed to divert the oppressed workers from their liberation.  Max Horkheimer of the Frankfurt School is credited with arguing a theory is “critical” if it seeks “to liberate human beings from the circumstances that enslave them”, and critical theory was applied to interrogate how power was used to perpetuate oppression.

Critical race theory is a variant of what began in the 1970’s as critical legal studies.  Critical legal studies looked at our laws with the assumption that law oppresses people, especially minorities, and examined how power was used to create and enforce the law.  Restrictive racial covenants in property deeds was an example of the use of law to perpetuate racial oppression.  Denying women the right to vote and prosecuting women like Susan B. Anthony in 1872 when she defied the law and cast a vote was an example of the use of law to perpetuate gender oppression.

Women gained the right to vote in Washington in 1910, Wyoming before that, and the US Supreme Court declared restrictive racial covenants were illegal and unenforceable everywhere in 1948.  Nonetheless, and not withstanding adoption of the 14th, 15th and 19th Amendments and a web of state and federal legislation outlawing discrimination based solely on race or gender, critical legal theorists concluded that the power of the oppressors was  embedded in our political structures and infects our laws today to perpetuate bias and discrimination against minorities and other marginalized communities.  As Samuel Gregg puts it in “Liberalism’s Civilization Problem,” Law and Liberty, September 7, 2020, the left’s “insistence that most of the West’s achievements are primarily masks for endless oppression largely flows from the left’s generally negative view of Western civilization” (emphasis mine).  In this dystopia there is no arc of justice, instead, US history is irredeemably rotten to the core.

Critical race theory proceeds from the fallacy that a binary of white and black, or white and everybody else, is the only appropriate frame of reference for a discussion of race.  Applying Ockham’s Razor to inconvenient facts, this binary ignores the history of racial bias against the Irish, Italian, Jewish people and many others ordinarily thought of as white.  Starting with this assumed racial binary, the critical theorists contend racial bias is embedded not only in our laws, but also our language, media, political structures and culture, and they set out to look for it.  Ignoring all the steps we have taken to eliminate racial prejudice from our laws and institutions, practitioners of critical race theory rediscovered what Stokely Carmichael described as “institutional racism” in his 1967 book, Black Power: The Politics of Liberation.

It’s called systemic racism today, and its corollary theory holds that implicit bias exists even among those who deny any bias at all.  Indeed, denial of bias is strong proof one is in fact sick with bias.  This demand to override a person’s reluctance to accept the fact that she is in fact racially biased is one of the most pernicious and dangerous features of critical race theory.  These are not mere thought crimes, they are unthought crimes.  And the unrepentant ominously resemble dissidents in the former Soviet Union or the unruly psychiatric patients in the film One Flew Over the Cuckoo’s Nest.

The Trump administration’s recent Executive Order and inquiry into Seattle’s work place training alleges that only White employees are required to admit to and denounce their racist impulses.  At first blush the required training appears to violate state and federal laws prohibiting discrimination based solely on race.

Aside from the totalitarian impulse to control what people think and the words people speak, two fundamental issues should make us wary of the growth of this ideology.  First, it is no accident these theorists too often are White academics and legislators.  Robin Diangelo is a White academic whose popular 2018 book, “White Fragility,” is a lecture to White people about how they got race all wrong and ignorantly so.

White men legislated poverty programs in the 1960’s that in the end further impoverished Black communities.  So much so that White men led by President Bill Clinton and then Senator Joe Biden legislated welfare and criminal justice reform that was directed against the Black community.  The reform ended “welfare as we know it” as Clinton put it and incarcerated large numbers of Black men, “super-predators” who needed to be brought to heel as Ms. Clinton put it to an all White audience in New Hampshire.  White folks telling Black folks what they need is a not so subtle form of oppression. White folks telling White folks what they shouldn’t think or say is almost as bad.  Isn’t it time for White folk to stop telling Black folk what they need?

Second, the critical race ideology claims all White people are infected with the racism disease and need help regardless of who they are or where they grew up.  In Diangelos’ world there are no individuals, no person is unique; instead, as a “race” we produce and reproduce racism in lockstep in every aspect of our daily lives whether we know it or not.  All notions of freedom are illusory.  The chains that bind us are no longer mere economic shackles, they define our very being which is, not coincidentally, not capable of redemption.

It is by definition a racist ideology, it divides our communities, and gives cover to those who want to destroy our history and institutions.  No leap of imagination is required to draw a direct line from the claim that systemic racism infects our institutions and must be pulled out by its roots to the destruction of civic monuments, attacks on the police, looting of stores and burning buildings in our cities today.

As Galatians 6:7 taught us, “whatsoever a man soweth, that shall he also reap.”

American Sports Are Letting Down America

Nearly 30 years ago, in a 1993 Nike commercial, professional basketball legend Charles Barkley fired the first shot at the “role model” concept popularized by Columbia University sociologist Robert K. Merton in the aftermath of the 1960s counterculture movement. “I am not a role model,” Barkley proclaimed in the half-minute spot. “I’m not paid to be a role model. I’m paid to wreak havoc on the basketball court. Parents should be role models. Just because I dunk a basketball doesn’t mean I should raise your kids.”

Barkley’s words landed with a force every bit the equal of former NFL quarterback Colin Kaepernick’s National Anthem knee 23 years later. Former Vice President Dan Quayle defended Barkley, while Barkley’s fellow NBA superstar Karl Malone criticized him in Sports Illustrated. Leading news magazines, including Time and Newsweek, published articles exploring the controversy. Newspaper columnists from coast to coast—on and off the sports pages—also weighed in. The topic still sparks debate today.

Of the many phrases and concepts Merton coined—including “self-fulfilling prophecy” and “unintended consequences”—“role model” has had the most impact. On the surface, the argument that young people tend to model their behavior after high-profile, successful adults is harmless. However, in retrospect, the elevation of athletes and other celebrities as primary figures in the formation of behavioral norms for young people helped create the conditions that are powering the destructive Black Lives Matter movement today.

Merton’s role model concept undercuts the importance of parents and nuclear families. That was the point of Barkley’s criticism. Feminists and other progressive critics of America’s “patriarchal” society—including the Black Lives Matter movement, whose Marxist-influenced statement of purpose opposes “the Western-prescribed nuclear family structure”—have used Merton’s concept to great effect. Muhammad Ali, Pete Rose, Farrah Fawcett, Barbara Streisand, Mick Jagger, Marvin Gaye, and Burt Reynolds infringed on territory primarily reserved for mom, dad, aunts, uncles, grandparents, and teachers.

Technology has helped advance the process, diminishing the influence of traditional authority figures and strengthening the reach of celebrities. Kids shut their bedroom doors, turn on their televisions, laptops, and game consoles, plug in earbuds, open social media apps, and disappear into a world far removed from mom and dad. With a mere push of a button they tune out the worldview of their families and tune in the worldview of athlete LeBron James, actress Lena Dunham, rapper Snoop Dogg, social media race-baiter Shaun King, and others like them.

On top of all this, we now see America’s enemies, particularly China, using these modern role models to promote racial division and destabilize our country—with those on the political Left as their accomplices. Today, they have coalesced around the Black Lives Matter movement to push America toward a level of racial dysfunction and animus not experienced since the Civil War.

It’s fitting that Charles Barkley fired the first shot against this trend, because American sports have become the Gettysburg of what some have called our “cold civil war.” And if China and the Left complete their radicalization of sports, our nation may never recover.

Sport has the power to change the world. It has the power to inspire. It has the power to unite people in a way that little else does. It speaks to youth in a language they understand. Sport can create hope, where once there was only despair. It is more powerful than governments in breaking down racial barriers. It laughs in the face of all types of discrimination.

Nelson Mandela, the South African freedom fighter-turned-statesman, spoke those words in an effort to heal the country he came to lead after spending a quarter century incarcerated for opposing apartheid. Mandela embraced sports’ power to bridge racial divides, looking on athletic competition as a kind of antibiotic for racial animus and discrimination. South Africa’s victory in the 1995 Rugby World Cup and Mandela’s presentation of the Webb Ellis Cup to team captain Francois Pienaar stand as an iconic symbol of unity in post-apartheid South Africa. Clint Eastwood directed a movie, Invictus, starring Morgan Freeman and Matt Damon, that memorialized the importance of the moment. It bears re-watching today.

Since sprinter Jesse Owens won four gold medals at the 1936 Berlin Olympics and boxer Joe Louis scored a first-round knockout over German heavyweight Max Schmeling in 1938, sports have served as a powerful racial unifier in America as well. The victories earned by Owens and Louis punctured Hitler’s Aryan superiority myth, unified black and white Americans in celebration, and established Owens and Louis as this country’s first black national heroes.

Owens and Louis laid the foundation for Brooklyn Dodgers General Manager Branch Rickey’s partnership with Jackie Robinson to integrate our national pastime, Major League Baseball, a decade later. Robinson’s successful integration of baseball, in turn, inspired Dr. Martin Luther King Jr., Rosa Parks, and the Civil Rights Movement of the 1950s.

Indeed, Barack Obama, America’s first black president—the world’s first black leader of a predominantly white country—credited Robinson’s career for his own political rise. “There’s a direct line between Jackie Robinson and me standing here,” Obama said in January 2017, while hosting the world champion Chicago Cubs at the White House. He continued:

There’s a direct line between people loving Ernie Banks, and then the city being able to come together and work together in one spirit. . . . Sometimes it’s just a matter of us being able to escape and relax from the difficulties of our days, but sometimes it also speaks to something better in us. And when you see this group of folks of different shades and different backgrounds, and coming from different communities and neighborhoods all across the country, and then playing as one team and playing the right way, and celebrating each other and being joyous in that, that tells us a little something about what America is and what America can be.

Yes, America is a shining example of sports’ transformative power. The games we play, the games at the center of our social behavior, combine with our founding principles to enhance the American experience. America’s enemies know this, which is why the culture war has moved to our arenas and stadiums. Sports are now in the same crosshairs as our Founding Fathers, under attack for past racial sins and unappreciated for their vital role in cultivating racial unity. Thomas Jefferson owned slaves, but by writing the Declaration of Independence he made the emancipation of slaves inevitable. American sports were once segregated, but no American industry can match sports’ empowerment of black men.

The black-player-dominated National Football League is the most powerful force in American popular culture. It provides the number one television show on five different networks—CBS, FOX, NBC, ESPN, and the NFL Network. In this era of have-it-your-way TV, where consumers record and watch shows when they want while fast-forwarding through advertisements, only live sporting events can be consistently counted on to deliver audiences that sit through commercials.

But while American sports have never been more influential, they’ve also never been more vulnerable to foreign influence. Their partnership with global brands and their desire to build global audiences have given foreign countries a pathway to manipulate American sports and culture.

Look at how China, with its 1.4 billion consumers, rules the National Basketball Association and its de facto parent company, Nike, the same way it rules Hollywood. Access to China’s consumers and Asia’s cheap labor (even sometimes slave labor) is the key to Nike’s economic growth. The Portland-based shoe and apparel manufacturer generates $40 billion a year in revenue. Its global reach, agenda, and revenue streams dictate the strategy of the $8-billion-a-year NBA. Many are unaware that Nike, and not the NBA, controls basketball. One could make a fair argument that the NBA is nothing more than the in-house marketing department of Nike.

Both Nike and the NBA kowtow to China, which explains their silence on the horrific human rights abuses inside China and the suppression of Hong Kong freedom fighters by China’s communist government. More important, Nike and the NBA’s China agenda helps explain why Nike pitchmen LeBron James and Colin Kaepernick enthusiastically smear the United States as inherently racist and evil. From Joseph Stalin to Fidel Castro to our own time, the communists’ favorite propaganda tactic has been to paint the West, and the U.S. in particular, as racist.

The militant social justice messaging of James and Kaepernick serves the interests of not only the Chinese Communist Party and globalist corporations like Nike, but also our political Left. Kaepernick’s National Anthem defiance in 2016 gave the Left an opportunity to politicize football, America’s new national pastime, and force it into the kind of “progressive” posturing already commonplace in the NBA and Hollywood. Arrogance, lack of foresight, and the advice of an inner circle that included former Clinton administration press secretary Joe Lockhart as the NFL’s vice president of communications, explain commissioner Roger Goodell’s laissez-faire approach to Kaepernick’s protest. Underestimating the determination of the Left and the power of social media to intimidate corporate America, Goodell and the NFL’s TV partners wrongly thought that the Kaepernick controversy would fade over time.

Instead, four years after Kaepernick first knelt, the Leftist mob has forced the National Football League, Major League Baseball, the National Hockey League, and the National Basketball Association to take their own knees and pay homage to the dishonest Black Lives Matter narrative on police brutality. The NFL plans to paint social justice messages across its end zones this season and to allow players to wear helmet decals with the names of alleged police victims. The San Francisco 49ers fly a BLM flag next to an American flag at Levi’s Stadium. MLB opened its COVID-shortened season with “BLM” carved into pitcher’s mounds, and the Boston Red Sox put up a 254-foot BLM billboard outside Fenway Park. NHL players are now regularly kneeling during the National Anthem. The NBA’s basketball bubble at Disney World is a virtual shrine to BLM: “Black Lives Matter” is painted on the court, players wear social justice messages on the back of their jerseys, and it’s major news when a player stands during the National Anthem.

The entire American sports world—a culture that traditionally celebrates victors, meritocracy, colorblindness, and patriotism—has suddenly immersed itself in black victimization and left-wing radicalism. A country that no longer believes in its founding ideals cannot prosper and survive.

If our sports stadiums and arenas have become the Gettysburg of the culture war, Lebron James and Colin Kaepernick are playing the roles of Robert E. Lee and Stonewall Jackson, fighting to divide the nation even further than it is. The mainstream media is only half right in casting them as modern-day equivalents of Muhammad Ali. Ali’s religious sect, the Nation of Islam, was certainly divisive: it championed black secession. But unlike the BLM movement, it also rejected victim-hood. Its founder Elijah Muhammad and its spokesman Malcolm X promoted bootstrap self-reliance and were disdainful of liberal politics. “The worst enemy that the Negro [has],” said Malcolm X,

is this white man that runs around here drooling at the mouth professing to love Negros and calling himself a liberal. It is following these white liberals that has perpetuated problems that Negros have. If the Negro wasn’t taken, tricked or deceived by the white liberal, then Negros would get together and solve our own problems. I only cite these things to show you that in America, the history of the white liberal has been nothing but a series of trickery designed to make Negros think that the white liberal was going to solve our problems.

Pro-BLM athletes today have moved beyond the idea of a role model that was debated in 1993—the idea of modeling behavior to be imitated, such as self-reliance, hard work, responsibility, and good parenthood. Through the power of social media, to which they are addicted, these modern role models exert influence by promoting commercial products and political causes. In the case of NBA athletes like Lebron James, this means turning their backs not only on the oppressed people of China and Hong Kong, but also on the poor and underprivileged in America among whom so many of these wealthy athletes grew up, and who they now condemn to victim hood and dependency with their political activism.

Charles Barkley was right 30 years ago. Parents, not athletes, should be role models. Today the situation is even worse, with sports further dividing an already dangerously divided nation, rather than providing the unifying and even healing force Nelson Mandela described. Predictably, there are now calls to boycott sports, and it seems inevitable that the TV ratings of the pro sports leagues will decline. This is unlikely to matter, however, to the suddenly-woke billionaire team owners and their handpicked commissioners.

As fans, we can only hope and pray that these feckless leaders will reconsider their embrace of the BLM cult—a necessary first step to returning American sports to what it has been in the past: a force for unity and a model of a diverse and colorblind meritocracy.

Here’s Greg

In case you haven’t noticed, I have been absent, UA, AWOL, or simply MIA. LOL. Sorry gang, but am still on vacation traveling in the RV visiting relatives. Am currently in MD to celebrate my daughter’s 60th this Saturday. For the first time on the trip, I have a solid Wifi connection so I thought I would peak at what is in my laptop. WOW. For those of you who do not know what minimize means, let me say again. NO EMAIL TRAFFIC. There are a few exceptions and Greg is one of them and he has sent me a good one. With that, here’s Greg.

Clearing the ledger

There is plenty to say about brevity, but that would defeat the purpose.  Neither time nor space affords me the opportunity to opine on the many headlines, stories, and political twists that comprise an average news day – let alone an entire week.  With that in mind, let’s clear the ledger.

The Federal Reserve has yet to learn the hard lessons of the 1970s inflation that when growth of the money supply slows, so does the increase in prices.

Considering the rapid increase in inflation, it should lead to a major reform in the capital gains tax but it won’t considering Congress is home to so many fiscal illiterates.

Ohio Gov. Mike DeWine signed a bill into law that allows all teachers to conceal carry a handgun – with librarians allowed to use silencers.

German leaders of the anti-immigration party called Angela Merkel the worst Chancellor in Germany’s history – now that is saying something.

Why can’t the left comprehend that Title IX was never meant to allow male athletes to compete against female athletes?

How fortunate the nation is that Merrick Garland is not on the Supreme Court.

With unstable financial markets, and increasing crime, Democrats want you to turn in your weapons.

 The tithe at the Church of Green Energy is well over 10% and it is anything but voluntary.

Leftist fanatics find their way to university faculties, journalists, and district attorneys, while those on the right are ostracized, threatened, and fired.

The issue of Nazism was settled in 1945 when the notion of white supremacy was soundly defeated by the forces of white privilege.

Every school board in the country needs to make the U.S. Citizenship Test, administered to naturalizing immigrants, a high-school graduation requirement.

At this point, any abduction by aliens, is not an abduction, but a rescue.

The ability of children to read has become secondary to what they are allowed to read – for fear they may learn to read between the lines.

At the rate U.S. drug laws are being repealed, Hunter Biden could get indicted for not bringing enough drugs for everyone.

Perhaps the U.S. needs to expand the census to South America so that they can register in advance of arriving.

Many Democrat policy proposals are not only radical, but scientifically, economically, and numerically illiterate: Medicare for All and the Green New Deal violate the laws of economics, physics, and mathematics.

Socialism is contrary to human nature, while capitalism is the only proven economic system.

Wise decisions about how to utilize deficits start with understanding the factors that actually play into it and sadly many of our politicians don’t have a clue. Congress does not want the responsibility of governing, just the perks.

Sen. Joe Manchin, a Democrat no less, has doomed humankind by not supporting Biden’s green agenda.  And here I thought Donald Trump was humanity’s greatest villain. You need a scorecard to keep track of who the Democrats blame as the greatest nemesis of humanity each week.

Arguably, the nation’s two most existential threats are China and our national debt and Republicans need to start selling it that way.

Arizona executed its first prisoner in nearly eight years and for his last meal he requested some Kentucky Fried Chicken before kicking the bucket.

Dr. Seuss’s latest: There is Disorder at the Border by Executive Order.

A cargo plane arrived in Philadelphia from Australia with three million cans of baby formula on board.  Apparently, each can is labeled: Foster’s. Relax, it is a joke albeit a weak one. But any mother reading this can at some level certainly relate.

Have you noticed that when any leftist threaten to leave the U.S., they only mention white enclaves like Canada, Australia, and New Zealand?

Heinz Field was renamed by the Pittsburgh Steelers to Acrisure Stadium as the insurance and real-estate company acquired the naming rights for next 15 years. Granted, a good number of Steeler fans may not be able to spell or even pronounce the new name; but they will certainly ketchup sooner than later.

A recession is when your neighbor loses their job, a depression is when you lose your job and a recovery when Joe Biden and Congressional Democrats lose their jobs.

The On-Deck Circus

Does anyone with a left and right brain – that works – understand just who it is we have leading our country today. Your absent minded, dementia afflicted Joe, drunken or drugged Pelosi  (as shown on my previous post), and of course this insignificant person who is a flaming idiot . I simply cannot comprehend anyone supporting this circus of people who are literally – piece by piece – destroying the United States of America.

I must apologize to some of you who I now are waiting with baited breath for my Open Letter to the Commandant. Trust me, I am working on it, but it’s tough as there is so much to say and I want to keep it short, concise, and to the point. Stand by it is coming soon.

Meanwhile I cannot help myself from commenting about these buffoons’ we have in such powerful positions and telling the secretaries of the various agencies what to do, especially SecDef and Sec of Treasury.. OMG!

Prior to joining the Biden 2020 presidential ticket, Kamala Harris was polling around 2 % – among Democrats – never making it to that first primary, so it comes as no surprise that her most recent poll numbers are even lower than President Biden’s.

Given his age and cognitive decline, if there was ever a presidential nominee who needed to select an accomplished vice president, it was Biden. Instead, we get arguably the least qualified one ever who just happens to be coupled with one of the more incompetent president’s in history. As President Barack Obama reportedly said: “Don’t underestimate Joe’s ability to foul things up.”

Then again, second raters habitually pick third raters, so they won’t be outshined. It could be argued that Harris was insurance against invoking the 25th Amendment.

Harris was wedded to Biden’s ticket because of her gender and ethnicity. Nothing else. It was no secret Democrats wanted a Black woman. Harris is not only the nation’s first female vice president, but the first Indo-Jamaican to become an African-American.

Nobody gave any thought to her ability to lead, unite the country, or formulate foreign and domestic policy. Having the correct résumé regarding identity politics cancels out capability and competence. When you pick a vice president purely on the expediency of identity politics without regard for merit, Harris is the result. Such rationale only poisons the well for every diversity and affirmative action hire everywhere.

When asked about the Kyle Rittenhouse verdict, Harris said, “There’s a lot more work to do on criminal justice equity.”

Meaning what, exactly?

Isn’t justice about impartiality and equal application of the law?

Her reply is the antithesis of the American ideal.

Harris was handed a golden opportunity as “Border Czar.” It could have been a defining moment, but Harris disappeared. She finally showed up not at the border, but in Guatemala to a chastening reception. She could have recruited every governor in a bipartisan effort to stem the tide but didn’t.

Harris displayed anti-Catholic bigotry in the confirmation hearings of Judge Brian Buescher by citing his membership in the “all-male society” the Knights of Columbus and their stance against abortion and same-sex marriage as grounds for not supporting him for the federal bench in Nebraska.

While campaigning in Florida she danced onstage in the rain to Mary J. Blige’s “Work That,” it was brutal to view. Democrats have said, “she’s not being used appropriately.” Perhaps consulting Willie Brown would most likely solve that issue.

Susan Rice has been rumored as a possible replacement for Harris. Rice is an Obama disciple with her hands pulling many strings with this caretaker president.

Naturally, the sycophants comprising the Bidenista regime responded saying any criticism of Harris is “sexist and racist.” This nonsense about not being able to criticize a minority woman politico because it’s racist and sexist is beyond parody. If we can’t criticize politicians, then the United States ceases to exist.

Harris sailed with the Titanic and remains an aneurism away from the Oval Office – a chilling prospect. No matter how Biden fouls up no sane individual wants him replaced by Harris, or in her absence – Pelosi – a shiver me timbers reckoning.

Harris is a lifelong political hack who has less appeal than Amy Klobuchar and who studied congeniality under Hillary Clinton.

What accomplishments did Biden and Harris register before the 2020 presidential election?

This is so funny, I mean these big boy CEOs were all asked the question by Senator Tim Scott’s (R-SC) what part of the GA voters law did they  believe was discriminatory.  One tried very timidly to answer, but didn’t answer the question. When  Senator Scott once again explained his question in more detail wait till you hear their replies.

These are big boys folks who decide what companies they will support and make loans to., which as you might suspect include gun manufacturers, etc. 

In case you can’t catch who they are ,here’s the list, JPMorgan Chase, Wells Fargo, Bank of America, Goldman Sachs, Morgan Stanley, and Citigroup. Doing business with any of these wokes who want to delve into politics along with Coke and Harry’s?  My investment companies are not listed, which is good, for if Schwab and USAA were  among them I’d drop them like a hot democrat
